Following on from our Free GDPR Guide for Childminders & Childcare Providers and as part of our work to assist our members and customers prepare for the new General Data Protection Regulation, we have now added a Privacy Notice template to our Policies & Procedures Pack …PLUS updated and improved some of our other policy templates to assist with compliance!
General Data Protection Regulation, or GDPR will supersede the UK Data Protection Act 1998 and come into force from 25th May 2018. GDPR will remain in place following Brexit and will affect all businesses across the EU including small businesses and sole-traders, therefore all childminders and childcare providers must comply.
Part of the regulation will require you to have a written Privacy Notice in place to explain clearly:
- What information you are collecting
- Your lawful basis for data processing (why you require this information and how it will be used)
- The methods you use to collect and securely store information
- Whether anyone else within your setting has permission to collect or access information, e.g. staff or assistants.
- Anyone else information is shared with and why
- The methods used to share information
- How long data is stored for and how it is destroyed
- Individual’s rights regarding collection, processing and access
Our Privacy Notice template covers all of the above from a childcare provider’s perspective and, supplied as a word document, is entirely editable should you wish to amend or add to it further to suit your individual business and circumstances.

Thank you very much for your message and for your interest in our GDPR resources. We are still working on the GDPR toolkit at the moment and hope to have it ready by the end of March / beginning of April. We may release the toolkit in parts so that everyone can get on with doing what is required but we will be able to make a better decision about this over the next week or so whilst we finalise some details.
Today we added a Privacy Notice template and updated some other policies within the Policies & Procedures Pack to assist with compliance.
In addition to preparing the toolkit, we are also working on revising the care plans/consent forms and creating a contract termination letter (to further explain what happens with data when a child leaves). Everything will be announced on the news page and in campaign emails once they are available.
