TYPES OF CONTRACT

There are five types of contracts included in this pack. Which contract you wish to use will depend on your service and the childcare arrangement required for each individual child.

  1. Childcare Contract

Childcare Contract

This contract will suit most childcare arrangements where care is required for regular hours throughout the year.

  1. Term Time / Holiday Hours Contract

Term Time_Childcare Contract

This contract is most suited to school aged children where the hours of care required differ during term time and school holidays. This contract may also be used where care is only required during term time, for example where a parent works in a school, college or university and does not require care during the holidays. A retainer fee may be charged for the weeks that the child does not attend.

  1. Temporary Contract

Temporary_Childcare Contract

This contract can be used for any temporary childcare arrangement. This may be suitable when providing holiday care for children, for short term arrangements or temporary changes, or to provide temporary cover for another childcare provider.

  1. Retainer Contract

Retainer_Childcare Contract

This contract can be used to reserve a childcare place that will not be required for a number of weeks or months. This may be for a new child who is to be starting at the setting or for a child who is to be absent for several weeks or months, for example where a parent is on maternity leave. A deposit or weekly / monthly retainer fee can be agreed to secure the place.

  1. Funded Hours Childcare Contract

Use this contract when all or part of a child’s care is being funded for example through the 15 / 30 hours free childcare schemes, childcare vouchers or via local college / university student funding. Use the included Funded Hours Agreement alongside the contract to keep it clear which hours are being funded and which must be paid for. Be sure to include details such as whether the funded hours apply all year or during term time only and any additional charges to be paid.

Addendum to Contract

Addendums are useful to agree in writing small changes mid contract.

Use this addendum form to put down in writing any agreed changes between the childcare provider and parents / carers such as amendments to working days or hours.

For bigger contractual changes it is advised to draw up a new contract to be signed by all parties.

IMPORTANCE OF A CONTRACT

It is always sensible to draw up an agreed contract at the beginning of any childcare arrangement. This clarifies from the start, the terms and conditions between all parties involved. A contract allows for any special arrangements to be agreed and sets out fees, charges and payment instructions clearly. An agreed contract will therefore help to avoid disputes occurring further down the line. It is important that all parties receive a completed, signed copy of the contract and keep it in a safe place until the contract is either renewed or terminated. Contracts act as a protection for both parents and childcare providers. Parents may withhold payment to a childcare provider if the agreed terms of the arrangement are not followed. Childcare providers can refuse to provide care for a child if terms are not followed or payments fail to be made on time. Contracts may be used in a small claims court, should either party wish to pursue legal assistance following a dispute.

All registered childcare providers are required to have policies in place regarding many aspects of their childcare setting including child protection, emergency, health and safety procedures, etc. They must also obtain written consent from parents / guardians to carry out certain activities, for example to administer medication, take photographs, etc. It is best practice to explain to parents / guardians the policies in place and obtain the written consents required at the same time as agreeing the contract.
